Ombudsman recommends filing of plunder charge against Senators Enrile, Revilla, Estrada

The Office of The Ombudsman has found probable cause to indict Senators Juan Ponce Enrile, Ramon "Bong" Revilla Jr., and Jose "Jinggoy" Estrada with plunder due to their involvement in the alleged misuse of their pork barrel funds.

Pormal nang inirekomenda ng Office of The Ombudsman na makasuhan ng plunder sina Senator Bong Revilla, Senator Juan Ponce Enrile, at Senator Jinggoy Estrada kaugnay ng maanomalyang paggamit ng pork barrel.
Ito ay sa kadahilanang mayroong “probable cause” na makakapagpatunay na lumabag ang tatlong mambabatas sa Republic Act 7080 (An Act Defining and Penalizing The Crime of Plunder) at Section 3c ng Republic Act 3019 (Anti Graft and Corruption Practices Act).

Kasama rin sa nakatakdang kasuhan ng plunder ang itinuturong pork barrel scam mastermind na si Janet Lim-Napoles.

THE JOINT RESOLUTION. Matatandaang nagsampa ng reklamong plunder ang National Bureau of Investigation (NBI) at Department of Justice (DOJ) laban kina Senator Revilla, Senator Enrile, at Senator Estrada noong September 16, 2013.

Bukod dito ay naghain ng hiwalay na plunder complaint ang Field Investigation Office (FIO) laban sa tatlong senador noong November 18, 2013.

Kahapon, March 31, inaprubahan ni Ombudsman Conchita Morales ang rekomendasyon ng five-member panel na nagsagawa ng preliminary investigation kaugnay ng kontrobersiyal na pork barrel scam.

Sabi sa opisyal na pahayag ng Office of The Ombudsman, na inilathala ng GMA News Online ngayong araw, April 1:
“On the charges for Plunder, the Joint Resolutions concluded that the three Senators took undue advantage of their official position to illegally divert, in connivance with certain respondents, their respective PDAF allocations to the Napoles NGOS, in exchange for kickbacks/commissions…”

Napag-alamang tumanggap ng komisyon sina Senator Revilla (P242 million), Senator Enrile (P183 million), at Senator Estrada (P172 million) mula sa “ghost” projects ng mga itinayong “dummy” non-government organizations (NGOs) ni Napoles.

Base ito sa mga sinumpaang salaysay ng pangunahing whistleblowers na sina Benhur Luy, Marina Sula, at Merlina Suñas.

Nakasaad din sa inilabas na Joint Resolutions ng Office Of The Ombudsman ang resulta ng special audit report ng Commission on Audit (COA) para sa Priority Development Assistance (PDAF) disbursements mula noong 2007 hanggang 2009.

Dito ay natukoy ang mismong implementing agencies ng gobyerno, NGOs, at mga opisyal na sangkot sa mga transaksiyong may kinalaman sa maanomalyang paggamit ng PDAF.

Kalakip din ng Joint Resolution ang nakalap na beripikasyon ng FIO, kabilang na ang mga sinumpaang salaysay ng government officials at beneficiaries ng natukoy na pekeng NGOS.
